Event Marketing Strategies, Inc. (“EMS”) on behalf of the City of Columbus Recreation and Parks Department (“CRPD”) is awarding four (4) of prize packages as provided by Columbus Blue Jackets, Breezeline, G&J Pepsi-Cola Bottling Co, and Jackie O’s as outlined in these Official Contest Rules, to be awarded by July 30, 2022.

 

  1. Who Can Enter:

Contest is open to any person age 18 or older who is also a legal resident of the United States of America. Employees (including, but not limited to consultants, independent contractors, and interns) of Event Marketing Strategies, Inc., City of Columbus Recreation and Parks Department, Columbus Blue Jackets, Breezeline, G&J Pepsi-Cola Bottling Co, Jackie O’s or its affiliated companies are not eligible to participate.

 

  1. How to Enter:

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. Persons can enter by providing responses to surveys available at in the Jazz & Rib Fest mobile app, available for both Android and iOS. Entries may also be received by sending a self-addressed stamped envelope to: Event Marketing Strategies, 580 North Fourth St, Ste 230, Columbus, OH 43215 with name of entrant, phone number, email address and mailing address.

 

Entries must be received between Friday, July 22nd, 2022 at 8:00 a.m. Eastern Daylight Time through Sunday, July 24th, 2022 at 11:59 p.m. Eastern Daylight Time. Only one entry per person, per survey, will be accepted. By participating, entrants agree to be bound by these Official Contest Rules and the decisions of the judges. Only complete entries will be accepted.

  1. Contest Dates:

The contest begins Friday, July 22nd, 2022 at 8:00 a.m. Eastern Daylight Time through Sunday, July 24th, 2022 at 11:59 p.m. Eastern Daylight Time. All eligible entries must be received within this time frame as promoted.

 

  1. Prize:

The giveaway winner will be determined by random selection of all eligible entries. The random selection will be conducted by EMS and will occur after the conclusion of the promotional period. A total of four (4) winners will each receive one (1) of the four (4) prize packs. The prize winners shall be selected and notified before July 27th, 2022.

 

Winner will be required to confirm the following requested information with EMS: first and last name, email, mobile phone number and a physical mailing address to receive the awarded prize. The individual selected will have 24 hours to respond. Provided the winner responds in this time period, they will be presumed to be the winner. If no response is received within 24 hours, or if the prize winners are determined to be ineligible, EMS shall declare the prize forfeited, and a new winner will be randomly chosen from the alternates selected or the remaining eligible entries.

 

EMS, CRPD, and its affiliated companies are not responsible for lost, late, stolen, damaged, incomplete, mutilated, misdirected or undelivered entries or mail, or the unsafe arrival of the prize. Prize is awarded “AS IS.” EMS and CRPD make no offer of any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a purpose) in connection with this sweepstakes or any prize. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at EMS or CRPD’s sole discretion. Prize consists of only those items specifically listed as part of the prize. No substitution or transfer/assignment of prize by the winner is permitted.

 

  1. Odds of Winning:

A total of four (4) prizes will be awarded. Each entrant’s odds of winning depend on the number of entries received.

 

  1. Limits of Liability:

Each entrant and the winner agrees to release and hold harmless EMS, CRPD, Columbus Blue Jackets, Breezeline, G&J Pepsi-Cola Bottling Co, Jackie O’s their affiliated companies, and all of their officers, directors, employees, contractors and agents (collectively “Released Parties”) from, injuries, losses, damages or other liability of any kind that may arise from participation in the sweepstakes or from acceptance, possession, or use of any prize.

 

 

 

 

  1. Winner’s Responsibilities:

The approximate retail value of the prizes are as follows:

  • Breezeline Macbook and Mini iPad: $1,499.00
  • Jackie O’s Swag: $70.00
  • G&J Pepsi-Cola Bottling, Co. BBQ Pack: $50.00

 

The prizes are awarded to the winner and sent via mail (USPS, UPS or FedEx or another carrier deemed appropriate). The prize winners are solely responsible for all applicable federal, state, and local taxes, and for any expenses associated with receipt or use of the prize. The potential prize winners are not the official prize winners until eligibility is verified in accordance with these Official Contest Rules and until the prize winners provide all requested information and releases.

 

  1. Publicity:

Entrants authorize EMS and CRPD to use anywhere in the world and in all forms and media existing now or in the future, their name, photographic likeness, city and state of residence, entry materials and a quotation provided by the entrant for advertising, educational, political, trade, in promotional materials, on a winner’s list, and for any other lawful purposes without further compensation. The prize winners may be required to sign a publicity release prior to accepting the prize.

This contest and these Official Contest Rules are governed by the laws of the State of Ohio, and any dispute arising from this contest will be resolved by a Court with proper jurisdiction located in the State of Ohio. Entrants hold all responsibility to comply with any applicable federal, state or local laws in connection with their entry. EMS and CRPD are not responsible for any typographical or other error in the printing, the offering or the announcement of any prize or in the administration of the contest, whether caused by computer, technical or human error. EMS and CRPD are not responsible for late, lost, damaged, incomplete, illegible, faulty, or incorrect transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind that may limit a user’s ability to participate in the contest whether caused by computer, technical or human error. EMS and CRPD reserves the right to cancel or modify the contest for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the contest; or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the contest as determined by EMS and CRPD, in its sole discretion. EMS and CRPD reserves the right to disqualify, freeze or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Contest Rules. EMS and CRPD will have the sole discretion and the final judgment on all matters related to this contest, including but not limited to the right to make changes to or modify these Official Contest Rules or the prizes, or to discontinue, suspend, or extend the contest.   In the event EMS and CRPD chooses to discontinue the contest, prize winners may be drawn from current eligible entries.

 

  1. Privacy Statement:

Entrants understand that entry into this contest results in their agreement with the following privacy policy. EMS and CRPD will retain and use entries, including completed survey forms, to inform entrants about events and promotions. EMS and CRPD may also share information with its affiliated companies for promotional use. Any electronic promotional information from these parties or affiliated companies will contain an opt-out procedure to cease promotional contact, which entrant may elect to use. All entries are subject to the Ohio Public Records Act, Ohio Revised Code section 149.43.
